An appeals court has reinstated a lawsuit brought by the family members of ABC Sports cameraman Richard Umanksky.
Umanksky died after falling 8 feet from a platform where he was installing a camera prior to a Wisconsin-Iowa football game.
Lawyers for his estate say the platform lacked railings as required by Federal law. A lawsuit has been filed against an employee who was in charge of complying with safety regulations.

There is no doubt in my mind that there should have been safety railings. But I must be missing something because I am not sure why the suit was filed against the employee. It seems that ultimately it is the employer who is responsible. Can anyone enlighten me?
