Fan is suing Chargers on playoff refund plan

A Chargers season ticket holder has filed a class-action suit against the team in San Diego County Superior Court, accusing it of unjust enrichment for not automatically giving refunds to those who bought tickets to a second playoff game that was never played. Last season, fans willing to purchase 2007 regular-season tickets would be permitted to purchase tickets for January 2007 playoff games. As part of the sale, the suit states, fans were required to purchase seats for both prospective playoff home games.

But after the Chargers were eliminated in the first playoff game, the Chargers retained the funds for the second game, according to the suit. The plaintiff, Kells Christian, was informed by the team that he would not receive a refund unless he sent a written demand for a refund, along with a copy of his driver's license. The Chargers told him they intended to retain the funds “for any future transaction” by those who purchased tickets for a second playoff game. The Chargers issued a statement in response to the suit:
“Mr. Christian's story is that he called the Chargers and asked us for a refund. He states that we asked him to put the request in writing along with a copy of his driver's license. Rather than comply with that reasonable request, he chose to file a lawsuit.”
The suit claims these terms were not disclosed or agreed upon and that fans have “an absolute right to be promptly refunded.” It says Christian's 2007 season renewal statement did not disclose credit was due.
The Chargers “are holding funds used to purchase tickets to Game 2 that belong to hundreds of fans,” the suit states.
The suit seeks a refund, plus interest, and class-action status on behalf of all persons who paid in advance for Game 2 but didn't receive a refund or credit against other existing charges from the team. The total amount in dispute is more than $25,000 but does not exceed $5 million, according to the suit. Christian bought two $133 tickets for Game 2.

Hope he wins. That's absolute garbage. At the very least the team has to credit his money towards his 2007 season tickets.
