| Kyle Busch's Kansas Penalty Overturned In a rare move, the National Stock Car Racing Commission on Wednesday overturned NASCAR's penalties against Kyle Busch's team following a Busch Series win last month at Kansas Speedway. The three-member panel, which hears appeals of NASCAR discipline and seldom overturns the sanctioning body's decsisions, unanimously agreed that Busch's crew chief, Micahel Bumgarner, should not have been fined $10,000 for having a manifold that did not conform to NASCAR-approved gauges and other measuring devices. "While rules enforcement must, by necessity, be discretionary in areas not readily measured by gauge, scale or template, the current NASCAR Busch Series manifold rules place extra emphasis on a strictly visual determination of whether or not too much material has been extracted in the plenum area during the polishing process," the commission said. "By and large, officials need the flexibility to say when a modification has 'gone too far.' However, a direct comparison with the unpolished manufacturer casting or other approved pieces can be inconclusive in some respects without the introduction of additional enforcement parameters." Car owner Rick Hendrick was pleased with the decision. "We appreciate the commission giving us the opportunity to present the facts and send a clear message about our performance at Kansas," he said. "The team prepared a race-winning car that met every rule in the book. It's important that our fans, our sponsors and our competitors know that's the case."

| Re: Kyle Busch's Kansas Penalty Overturned I think they sent a message to NA$CAR Tech as well as the competitors: eyeballing won't cut it, there has to be an accurate guage by which to check/test adherence to the rules. 'course, NA$CAR still has the old reliable "actions detrimental..." rule to fall back on...
