Sterling Marlin and Joe Nemechek have sued Ginn Racing and Dale Earnhardt Inc. for alleged breaches of their contracts, which included a base salary of $1.2 million apiece. The separate suits, filed Sept. 7 in Cabarrus County, N.C., do not specify how much they have been paid or what they exactly are owed. Also suing Ginn and DEI are crew chiefs Richard "Slugger" Labbe and Peter Sospenzo. -- Scene Daily

I'm kinda confused here about why they suing DEI. Wasn't they already let go before DEI got Ginn racing?

Not sure, would need to see the whole court proceedings. As quick as things went. Nemecheck and Marlin were both let go right before the merger took place. Maybe DEI wouldn't take those drivers as part of the merger. GINN let them go to complete the merger and tried to get around the whole paying them thing, by saying the teams merged. It could be that Nemecheck and Marlin had contracts stating that they would get paid in the event of the merger or would be staying with the teams in the event of a merger and when. If any of this makes sense. I'm not a legal mind, I've just seen and heard many things.

Not sure why DEI unless they supplied the engines for Ginn racing. I don't blame the drivers at all on that one I would have sued too!

Personally, I'd give the nod to the drivers.

What amazed me was the fact that now the unwashed masses have an actual idea of just exactly what these kats make.

$1.2 million salary
45% of all winnings (in 2006 Nemechek won a little over $4 million)
30% of souviner sales
$500 travel expenses per race
motorhome reimbursement
a seat on the company plane for each race.
