| Re: Four numbers that Hendrick wants for Jr?? I've heard Jr. say 2 or 3 different times he wants to have the majority of input into the design of his car next year. He wants it to be "really cool, something his fans will really love when they see it." So I imagine that includes not only the paint scheme, but the number. And it has to blend with whoever his new sponsor is. I'm sure he has an idea what his ideal number would be, and if he can't get it, what number would come next, and so on. I guess we'll all know when they unveil it. Whatever it is, I'm looking forward to seeing it put the 24 in the rear view mirror |

| Re: Four numbers that Hendrick wants for Jr?? I was also listening to SISIUS' "Morning Drive." I understood David Poole to report that Hendrick had asked for a "copyright" on the five numbers. I doubt this report, as it was reported. My problem is How does one "copyright" a number?" IF a team can copyright a number, doesn't this mean that the teams own the numbers, and not NASCAR, as we have recently been led to believe? This would mean that an owner's copyrighted number could never be used by another team unless (a) a royalty is paid to the number owner, or (b) the copyright expires (25 years?) Maybe Poole meant copyright on a number's design, but I can recall absolutely no mention of such a copyright being made. To sum it up, this report confused the Hell out of me.

Rick Hendrick probably looked at what Richard Childress did in 1996 when he copyrighted the #3 design, which means RCR owns that specific stylized #3 used on Dale's cars and merchandising. Maybe that's what Hendrick was talking about and what he wants to do with the 5. Why he didn't say that specifically, I don't know. |

Hot off the press "Hendrick Motorsports has applied to the United States Patent and Trademark Office for potential use of five numbers next season for Dale Earnhardt, Jr. The numbers under consideration are #38, #51, #81, #82 and #58. Filing with Patent and Trademark Office does not guarantee NASCAR approval to use any of those numbers, but does prevent an outside party from trademarking the specific font and graphic package used by Hendrick on its racecars, diecast collectibles and souvenirs. Hendrick filed for the #81 on July 25th, with the most recent filing being for the #38 on August 9th. There have been reports that Hendrick is attempting to strike a deal with Robert Yates Racing for the #38 next season, but my [Dave Moody] sources tell me that the deal is not likely to happen."
