| Should RCR sue Nascar? Well it isn't looking good for RCR and AT&T. Looks like Nascar has won and AT&T will be off the car this weekend. That being said I really don't see how AT&T stays on with RCR. They are killing the Cingular name so what would be the point of putting it back on the car? Do you think if RCR loses sponsorship because of this should Childress sue Nascar for the remainder amount left on the sponsorhip package between RCR and AT&T? After all it is Nascar's fault they will lose their sponsor. I say RCR should bring up a suit against Nascar and Sprint. I know Nascar is a private business and it is play by their rules or get out. If tracks can sue Nascar and win to receive a second date. Why can't RCR sue and win to get their funds? It should be interesting to say the least. |

| Re: Should RCR sue Nascar? This is how I see it. Nextel signed to be series sponsor and said no new cellular companies could come in. So Cingular changed to AT&T. Nascar said no and Sprint Nextel said no. But the title sponsorship was signed with Nextel, not Sprint. So how can Sprint be brought into it? Nextel said no new cellular service could be brought in and then they bring one in. If Nascar said no to Cingular going to AT&T, why didn't Nascar say no to Nextel going to Sprint? Oh thats right, Nextel pays Nascar and Cingular pays Childress. Yes I think RCR should sue. |

Although the injunction permitting AT&T's logo to be on the 31 car was lifted, the trial has yet to begin in AT&T's suit. It would be premature for RCR to sue NASCAR for lost revenue until that suit is decided. Being the devil's advocate: AT&T was arrogant in believing they could absorb Cingular and ignore Cingular's existing, legal contracts which didn't fit their plans. Legally, the crux of the matter is whether AT&T merged with Cingular or if it was an outright buy out. If the later, then Cingular ceased to exist when it was bought and absorbed into AT&T, making AT&T a new entity with regards to the NASCAR-NEXTEL contract.

| Re: Should RCR sue Nascar? I don't know about all the merging and if it was bought out or what. All I know is 4 years ago my phone was AT&T and then a couple years ago they sent me a letter saying I now have Cingular and now I'm back to AT&T. Guess in a couple more years, we'll be back to Cingular. I think if Nextel had it in the contract they could change their name once, then Cingular and Altell should have been given that same right. But I still say it's sad that they are a sponsor of a competitive sport and they're scared of competition. Of course if I had all the problems they have, I'd be scared of competition too. |

One thing I'm currently tryin to dig into right now is if Motorola is gonna bounce from Nextel after the little riff early this season when Robby Gordon was told to take the Motorola decals off his car. Rumor is(like I said tryin to dig into it right now) that Motorola execs were P.O.'ed...

| Re: Should RCR sue Nascar? I agree, that's the best way to to it, as long as it doesn't look like the owners are creating a little union against NASCAR. That was tried in 1961 when Tim Flock and Curtis Turner tried to start a drivers union. Bill France shot that down like a quail over a baited field. And in 1969, when Richard Petty started the Professional Drivers Association, Bill France wanted no such thing in NASCAR, and guess who won that one? But it's a different time and era, and it's owners who would do this instead of drivers. So it stands a better chance of working. |

I think majority of the sponsors would be on board to support their owners and drivers. There are only three sponsors that would fight this Sprint, Goodyear, and Sunoco. Those are the only three sponsors with exclusive rights. All other sponsors either have their competitors already in the sport or have the ability to join. I would think if a owner went to his sponsors and said I want to add another team and I have a sponsor willing to throw in 30 million but Nascar says no that those sponsors would jump on board. It would give a better chance to making the teams better. If the teams are running better than the sponsors look better. You don't think Homedepot welcomed FedEx aboard? |
