Yes. Childress does own the 3, so no one can drive it unless he says so, which right now it looks like he dosen't want it to be driven. It just shows the respect he has for Sr.

Well if he does go to Hendrick, he will be automatically hated by some fans. So yea, right now I would say Jr either stays with DEI or goes to RCR.

If, If, If !!!! If pigs could fly then we'd all be rich, or in trouble down below. My take is that Jr. will end up with a peice of DEI. Maybe not as much as he'd like to start off with but enough to keep him interested. Possibly the share would grow as time goes by. It's real hard to tell if Teresa is willing to give it up. Teresa is no dummy. She has been involved in racing for many, many years and I suspect she can see that there is money to be made and there is no (legal) reason why she shouldn't get her cut of it. I believe if Jr. hangs in there and shows his true loyalty it will pay off for him.

I think if Lil' E goes anywhere, it'll be to RCR. I'd like to see him stay with DEI, though. It'll all be his some day, won't it?

I'm confident that there is nothing written in stone that Jr. gets the company. Keep in mind that there are 3 other Earnhardts that just due to their relationship with Sr. should get a piece of the pie. The oldest sister is an advocate of getting a piece of the action. Kerry is a wanna be driver and then there is the youngest daughter. I would have to believe that Teresa has a will specifying who gets what and how much.

So NO it will NOT ALL be his someday. If it is he'll have to buy it all. I don't think he is there financially yet.

If Teresa was Jr's REAL mom, would we be having this conversation? I mean wouldn't it be more like, "Jr gets the buisiness when MOM says so"? Somehow Teresa seems to have become "The Evil Stepmother". Remember this WAS Sr's buisiness and Teresa WAS his wife, every bit as much as Jr's Mom was. So I think the buisiness belongs to whomever Sr's will stipulates.

Yup.

Kerry has given it the good try. Racing doesn't seem to be in his blood. Jr. surely is a chip off the old block. Kelly and Taylor must have some interest, but I don't know for sure.

Since I know little to nothing about the law, except for how I break it, I would note that in some states when one spouse passes away the other can sign a piece of legal paper stating that although my spouse has a will I hereby make it null and void since I am the spouse and the survivor.

Scooty I'd guess you are correct in that if Teresa were his real Mommy we'd not be having this discussion ... but she isn't. She has become the "evil stepmother" because we and the media are the ones making the big issue about it. Yes Jr has stepped up saying he wants a piece of the pie and she seemingly made a stupid statement but in reality how many times have we all read some media based piece of information only to find out somewhere down the road that it wasn't quite the way we thought it was. Who knows .... maybe Sr. didn't want Jr to have a piece of the action. Until someone tells us and we see all the current and past legal mumbo jumbo .. we are just spittin' in the wind. I don't care if Nascar.com or Jayski or even Brian Williams tries to convince me. It's all media hype.

Missing word/representation in the above is "sole" as in singular and last. While there exist variations by jurisdiction, if "blood" remains, it ain't no slam dunk for anyone anywhere.

12 years ago Dear Old Dad went to his reward and my Mother signed the paper doing just that. Plenty of blood left behind. 6 kids !!!

well lets see nascar owns all the numbers and leases them to the teams, normally a team must attemp 3 or 5 times to make a race to keep the lease active, in the case of the #3 nascar has waived the attemts but RCR still pays the lease on the number .

as far as I understand, dale and teresa started DEI together, so it wasn't all Sr.'s to leave to anyone , I also believe that teresa was the named owner of DEI in case dale was killed while racing. jr may be the heart of DEI but he doesn't own it he is merely a contracted driver.

I do think that Jr. will get an interest in DEI in his contract but it won't be controling interest, at least not right away.
