This has to be one of the most ridiculous things I've heard in quite some time.

Apologies if I miss it as I scanned this string, but why was this kid humiliated and embarrassed? Was he pictured with the 24? JUST KIDDING! Even I wouldn't have a problem with that. As someone touched on earlier, if I got my mug on a brochure, I'd be handing it out to friends and family.

I've said this before, but having been in the pits at NHIS several times, if I get hurt, too bad. Even if a crew member walks up to me and hits me over the head with a crow bar, too bad! If you've never been in the pits before a race, trust me, if you don't get the h*ll out of the way of the cars, you WILL get hit or at least shoved out of the way!

What's the difference between this and people who happen to be in the background of a newspaper photo? If you don't want to risk getting your picture taken, STAY HOME!

I don't know how many tracks do this, but at NHIS, there are people walking around the stands with a digital camera and they will take your picture for free, then they load these photos onto a website, and you can download them if you'd like for a price. What's the difference?

As for lawyers ... OJ got off!

don't think the kid was embarrassed .. think the dad only said that so he could afford to send his kid to college 'cause he blew all the kids college money on beer at the races!

I've been embarrassed may times in my life. I wasn't happy with a photo of me during a friends wedding and my friend posted it on the Internet. Perhaps I have a case or two for him as well!

I happen to know for a fact that this kid was approached by many drunks at the track.....and the little guy was scared to death. I was there I saw it.

If you were the dad or this happened to your kid.....Im sure it wouldnt be just another case to you.

What does the kid being approached by drunks have to do with whether or not a race promoter can use your image in brochures? I'm afraid I'm missing the point of your post, my anonymous friend.

why would a bunch of drunks "approach" a kid? Only reason I can think of is the kid was carrying beer .. probably for his dad.

And, what did you do to help the kid ward off the drunks, mr or ms anonymous?

Come on, Unregistered--

I second the comment from Lefty. If in fact this kid was being approached by drunks, what does this have to do with the brochure. If the promoter would have paid the father for the rights up front, would that have made a difference? Ok as long as they pay?

As Racer Duck said, why would these drunks approach a kid? Trust me, the so-called "drunks" at the track approach the scantily dressed women, not little boys.

I don't blame the little boy, but I ask the father: Hello? If his son is that hypersensitive, why on earth did he bring this child to the track? And where was the father when this child was being "approached"? Seeking autographs? As Racer Duck touched on, if you saw it, why didn't you stop it?

I've had my a$$ grabbed by a pit member while posing for a picture. Did I sue? No. And trust me, I am not a pit lizard.

Is the father going to press charges against the drunks that scared his son? I bet not!

This is an absolute disgrace, and what's more disgraceful is that there is a lawyer who has actually taken the case!

Couple of comments here. First I'd suspect the lawyer taking this case is doing it for exposure and the chance at a few bucks if he wins. I'm sure the percentage is a minimum of 33%. Look at the exposure right here, then Jayski and who knows how many other places.

Second the unregistered poster has already posted here in this thread once. Through the magic of being a moderator I can see things you mere mortals cannot. My perception of both comments made by this person is that they were made just to incite more discussion.

This thread proves yet another case FOR tort reform. How about this, make any attorney who takes a "personal injury" case, such as the one we are discussing, be liable for all legal and court costs, should the case be lost?

If this were to become the law of the land, methinks the majority of these frivolous law suits (hot coffee at McD's, fat Burger King kids, et. al., would immediately almost disappear.
