| Re: Ex QB Arrested With Teens Ex-Colt faces felony charge, up to 3 years in prison Hosting a party for Park Tudor graduates at his Zionsville residence, former Indianapolis Colts quarterback Jack Trudeau collected car keys and listed names on a clipboard -- but denied that he supplied any of the alcohol that authorities found there early Saturday, according to Boone County court documents released Monday. The police affidavit in the case also says that former Conseco chief Stephen Hilbert was a guest at Trudeau's house and told officers they would need a search warrant after police showed up to check on a report of juveniles drinking at the party. Boone County Sheriff Ken Campbell said Hilbert is involved in an ongoing investigation.Authorities filed a felony charge of obstruction of justice Monday against Trudeau, who could face up to three years in prison. Police say he failed to provide the list of the young people attending the party. The court documents offered other new details of the police decision to charge the former NFL player, whose arrest underlined what have become annual warnings by authorities that parents are breaking the law if they tolerate underage drinking at graduation parties. Trudeau was charged after police found students from Park Tudor, a private school on the Far Northside of Indianapolis, celebrating their graduation with alcoholic beverages in his home. According to the police report, when officers arrived, Trudeau was at the front of his home with a clipboard in his hand. He told officers that he was taking everybody's names and keys so no one could leave the party. According to the court documents, he said that if underage drinking were going on, he didn't supply the alcohol -- but added that he wasn't checking people's coolers or bags as they entered the party. Authorities said Trudeau had told his guests that he didn't want them to wind up like Jon Pavey, a star receiver on the Zionsville Community High School football team who was critically injured in a one-car accident May 25. According to a toxicology report taken two hours after the accident, Pavey had a 0.09 blood-alcohol level, above the legal limit for adults of 0.08. He remains in stable condition at Methodist Hospital. Authorities said that after they arrived at the Trudeau residence, they and the former Colts player went around to the back of the home, where officers saw several open containers of beer, rum and wine, and called for other police to assist them. Officers said that when they asked Trudeau to check on the welfare of the young guests, he replied: "How can we make this go away?" After officers pressed the issue, Hilbert, who was at the party with his wife, Tomisue, told the officers to get a warrant. After returning with a search warrant, officers gathered the graduates and gave breath tests. Eight of the partygoers tested positive for alcohol; seven were charged with either minor consumption of alcohol or minor possession of alcohol. The eighth was younger than 18 and released to his parents, who were also at the party. When officers searched a wooded area behind the house, they found five more partygoers hiding. All five tested positive for alcohol and were arrested by police on charges of resisting arrest. Four of the young men were charged with illegal possession by a minor. Police said that during their search of the house, officers asked Trudeau for the clipboard with the names of the partygoers, but Trudeau said he didn't know where it was. Trudeau later was asked for the clipboard again, and he once again denied having the list or knowing where it was, police said. At that point, Trudeau also was arrested. Trudeau's daughter was one of the graduates at the party but wasn't charged with a crime. Zionsville attorney Mike Andreoli, representing Trudeau, had little comment. He did say Trudeau and his wife did nothing to violate the law. He added there was "no question" that Trudeau is being made an example of by local authorities. "Whether they're doing it artfully or appropriately, we'll leave that for another day," he said. "Certainly the message is they're not going to tolerate underage drinking in Boone County." He said the Pavey accident added to Boone County officials' concerns and contributed to officers' "excessiveness." "When you force a 7-year-old boy to take a breath test, I don't think you're going to get a lot of people out there -- even those who are firmly behind the sheriff's attempts to curtail underage drinking -- who don't believe that's a bit excessive," he said, adding that several children between the ages of 7 and 10 were at the party. Campbell said his deputies have investigated several underage parties this year and Trudeau wasn't being singled out because of his fame or the Pavey incident. The deputies tested every child for alcohol, he said, because the search warrant specified everyone younger than 21 would be tested. "What's to say that one of those younger children didn't pick up one of those (alcoholic) beverages and consume it, unbeknownst to the parents," he asked. "Our officers were kind, polite and professional, and I don't think we traumatized them in any way." Although he acknowledged the parents supervising the party may have thought they were doing a good thing, Campbell said they were sending an "improper message." "While I appreciate the fact they were taking their keys and their names and prevented them from leaving . . . it doesn't make it legal," he said. "(They're saying), 'You can't drink until you're 21 except when an adult takes our keys or . . . at certain times.' " Officers confiscated the remaining keys. Six sets of keys have yet to be picked up at the sheriff's office, Campbell said. Several of the cars were parked at the Trudeau residence. Park Tudor has hosted workshops for students and parents on the dangers of illegal activities such as underage drinking, said school spokeswoman Lisa Hendrickson. "Unfortunately, sometimes people make choices that they regret in retrospect," she said. "We do our best to educate them in not only school matters, but also in personal matters as well. The guy is taking names and keys to keep high school grads off the street and they are going to make an example out of him...Oh please... What? is there not enough freakin crime around to go after? For better or worse, graduating high school kids nation wide are hosting said parties...(I for one do not drink and have never drank...a religious thing with me)...but as misguided as he was, he appeared to be acting in a some what responsible manner when it comes to drinking and driving at least... (BTW, states, like Georgia I believe, actually allow underage drinking if it's within the confine of your own home... go figure...) And sure, it's misguided and wrong...but hardly worth the freakin amount of ink and legal they are putting into this one...I for one would rather them actually stop a drug lord, put an end to a gang, address a school shooting, do away with a sexual predator etc...but hey, NFLers get you ink, so its vogue right?...Somewhere I am sure there is a Sherrif running under the slogan, "I kept the city clean of NFL petty crimes"... Dude get a sense of perspective on these things... BTW, if I had a daughter as said party, then shame on me for not knowing where my kid is at... |
